Lawyer in Mexico and Avocat in France (Paris), with 20 years of experience and significant expertise in arbitration and corporate law gained in prestigious firms in Mexico, London, Paris and Munich.

Fernando has participated in almost 20 high-profile arbitrations as counsel or as tribunal’s secretary across many industries, under most arbitration rules (ICC, SCC, DIAC, CAS, ICSID, UNCITRAL, NAFTA and Energy Charter Treaty). 

He served as assistant to the tribunal in arbitrations presided by Prof. Klaus Sachs, involving construction and energy disputes against Latin American, European and Arab States.

Fernando has represented both States and investors across continents, notably in the energy, natural gas, real estate and construction sectors. In particular, he was the Mexican lawyer that represented a Canadian investor in a NAFTA arbitration, in the first case of denial of justice by Mexican courts (ICSID Case No. ARB(AF)15/2).

Fernando has also acted in commercial arbitrations as counsel and tribunal’s secretary in the area of corporate law disputes and breach of contracts, while advising on points of French and Mexican law and enforceability of arbitral awards. He also represented a football federation before the Court of Arbitration for Sport (CAS).

In parallel to working as an arbitrator, Fernando is looking to collaborate with law firms that wish to add his skill set to their teams on a temporary basis. His role would range from overseeing most aspects of the arbitration to handling specific issues of jurisdiction, facts, points of domestic laws, quantum, or the cross-examination of experts and witnesses.
This would benefit both firms and their clients, by being an efficient and cost-effective solution by including external counsel in their team with a reduced risk of conflict of interest.   

Recent experience 

◊ Represented a Canadian investor (Lion Mexico Consolidated) in a landmark decision of denial of justice by Mexican courts under NAFTA rules (ICSID Case No. ARB(AF)15/2).

◊ Acted for India in an UNCITRAL arbitration concerning the operation of a gas power plant.

◊ Assisted Morocco in ICSID proceedings initiated by a German corporation with respect to the alleged ban on the export of processed scrap metal (ICSID Case No. ARB/19/2).

◊ Acted for a French company against an Eastern European country in connection with a heating and electrical power generation project.

◊ Acted as Tribunal's Assistant in an ICSID arbitration between an Emirati investor and an Arab State in relation to the construction of a multi-billion dollar metropolitan park (ICSID Case No. ARB/18/11).

◊ Assisted the President of the Tribunal in an ICSID arbitration between US investors and a Latin American State relating to the seizure of property and the suspension of construction works of a real estate project.

◊ Assisted the President of the Tribunal in an intra-EU arbitration under the Energy Charter Treaty between a Cypriot investor and an EU country.  

 ◊ Assisted in an ICC arbitration seated in Frankfurt between two leading automotive companies in Korea and Brazil, relating to the renewal terms of a multi-billion dollar contract.

◊ Represented a Lebanese company against a French company and a company in the BVI, in ICC arbitration proceedings in relation to a duty free concession in a Middle Eastern country.

◊ Acted as de facto secretary in a DIAC arbitration between a Dubai-based company and a Qatari company, concerning the breach of contract in relation to the provision of equipment in the health sector.

◊ Represented an African football federation under CAS arbitration proceedings involving the eligibility and suspension of players in the Africa Cup of Nations.

◊ Advised clients regarding the enforcement of arbitral awards in the USA, Mexico and France.
